Purpose

To consider the findings of the one-year review of the Housing Compensation Policy and seek approval of the revised Policy. While the core principles and approach of the existing policy remain unchanged, the proposed amendments will align the policy with updated Housing Ombudsman guidance, clarify the Council's approach to compensation claims, contractor responsibilities, rent arrears and contents insurance, and strengthen associated operational and monitoring arrangements.

Decision

To adopt the proposed amendments to the Compensation Policy for North Yorkshire Council’s Housing Services, following consideration of the findings from the policy’s one-year post-implementation review.

Reasons for the decision

While the core principles and approach of the existing policy remain unchanged, the amendments align the policy with updated Housing Ombudsman guidance, clarify the Council's approach to compensation claims, contractor responsibilities, rent arrears and contents insurance, and strengthen associated operational and monitoring arrangements. The changes therefore support the Council’s commitment to continuous improvement and regulatory compliance.

Alternative options considered

The option not to adopt the proposed amendments, and to instead continue with the existing, unamended version of the Compensation Policy, was considered and rejected. This option would have failed to demonstrate compliance with new regulatory guidance and to offer accountability for improving the service offered to council tenants. Without addressing the policy gaps raised in the review, the Council would have risked failing to demonstrate a commitment to meeting both the Housing Ombudsman’s compensation guidance and the Regulator of Social Housing’s Consumer Standards.
