Purpose
That in accordance with the
Cabinet paper of 12th February an award will be made to
Connect Healthcare Rotherham CIC via the Non-core Framework
Agreement on the existing contract to deliver the activities
required in the utilisation of the Local Stop Smoking Services
Support Grant 2024/25

Brief Description of
Decision:
The officer decision confirms
the decision to award Work Order(s) to the total value of
£344,845 to Connect Healthcare Rotherham CiC via the
Non-Core Framework. This funding is from the Local Stop
Smoking Services and Support Grant 2024/25. The Work Order delivery
period commenced 01 of April 2024 and will expire 31 March
2025.
The Work Order
is required to deliver specific activities in the utilisation of
the Local Stop Smoking Services and Support Grant
2024/25

Order awarded will be made available on the Council’s
contracts register,

Tender.
Reasons for the
Decision:
The
decision is being made in accordance with the Council’s
Constitution Appendix 1, Executive
Procedure Rules, Part 3, 7(4)(i)
decisions which are a direct consequence of implementing a previous
key decision and were contemplated by the decision maker when the
original key decision was made.
The
decision is made in order to deliver the
additional service capacity described in the Cabinet paper of
February 2024. Connect Healthcare Rotherham CIC are the Councils
sole provider of the pathway for local community stop smoking
services.
The
Core Contract and Non-Core Framework were awarded following an
openly advertised competitive procurement process undertaken in
line with the Social and Other Specific Services provision of the
Public Contract Regulations 2015 (as amended) (PCR’s). The
award of the Work Order uses the Non-Core Framework, which permits
the commissioning of additional activity as described.
The
services specified in the Work Order are health and social care
services that fall within the procurement regime established by the
Health Care Services (Provider Selection Regime) Regulations 2023
(PSR Regs) that came into effect on 01 January 2024.
Although this decision is made after the 01 January 2024, the
Officer has been advised that the saving transitional arrangements
set out in Regulation 29(3) of the PSR Regs will apply to it and
that they are satisfied. It follows that although the contract has
been called off under a framework agreement made under the
PCR’s, it is valid under the PSR Regs.
Details of alternative
options considered and rejected:
Any alternative
procurement procedure would need to comply with the requirements of
the PSR Regs. This would require an entirely new procurement under
the terms of the PSR Regs and entail considerable delay. Only the
proposed arrangements using the existing framework agreement will
meet the requirements of the PSR Regs transitional arrangements and
enable delivery of the services within the required time
frame.
