Purpose
The proposed acquisition will
facilitate the erection of a new retaining wall adjacent the
cemetery. The retaining wall is in a poor state of repair and
urgent works are required to prevent collapse.
A scheme has been prepared to
erect a new wall and budget is available. The acquisition of these
lands will facilitate the construction of the new wall and allow
for rights of access to enable the works.

Decision taken under the powers granted to the property officer
under section 29.10 of the Council’s Financial Procurement
Procedure Rules.
Paragraph 29.10.1 and 29.10.2 states where sufficient budget
provision for an acquisition exists within the total Council
budget, and the cost of the acquisition is less than £100,000
the Property Officer may approve a purchase of land or buildings in
consultation with the relevant Cabinet Member.
Decision:
That
the Assistant Director for Property and Facilities approves the
acquisition of both of the sites identified on the plans at
Appendix 1. Property and Facilities Services will manage the
acquisition process with the proposed sellers, in consultation with
the Council’s Section 151 Officer and the Cabinet Member for
Transport, Jobs and the Local Economy.
Reasons for the
Decision:
The
land is required for the stabilisation works to a closed cemetery
where the Council has a statutory duty to do the works.
Due
to this direct approach to acquire the land by private treaty to
satisfy S123 Local Government Act 1972 a valuation has been
authorised internally by a Registered Valuer to determine the price
to be paid by the Council.
It
is recommended that the land is acquired by the Council to carry
out the works required to stabilise the retaining wall.
The
works will involve constructing a new retaining wall to stabilise
the retained cemetery land.
