Purpose
This report sets out a proposal
for the early termination of the Car Park Management Agreement
between the Council and the owner of Central 12, Derby Road,
Southport.
Decision
Decision(s): That:
(1)
the early termination of the Car Park Management
Agreement between the Council and the owner of Central 12, Derby
Road, Southport be approved; and
(2)
the Assistant Director of Place (Highways and Public
Protection), in consultation with the Chief Legal Officer, be
authorised to agree an appropriate Deed of Surrender for
terminating the agreement on a mutually agreed date, and without
financial detriment to the Council.
Reasons for the Decision(s):
The owner of Central 12 has
requested the early termination of the Car Park Management
Agreement. The basis for agreeing an early termination date would
be that the Council suffers no detriment financially and continues
to receive all income it would be due under the
agreement.

Financial Procedure Rules, this is a decision for the Cabinet
Member Regulatory, Compliance and Corporate Services

Risk Implications)
The Car Park Management
Agreement includes a Break Date in April 2026, after which date
either party can terminate the agreement. The Council could refuse
the request for termination prior to this date, but sees no
advantage in doing so, as long as the Council suffers no detriment
financially and continues to receive all income it would be due
under the agreement.
