Review of the highway status of various locations and proposed Section 228 Highways Act 1980 adoptions.

Purpose
To consider the highway status
of a number of areas across the borough and seek approval for the
Chief Legal and Democratic Officer, in conjunction with the Head of
Highways & Public Protection to legally “adopt”
areas of highway, as detailed within the report pursuant to section
228 of the Highways Act 1980.
Decision
Decision(s):
That Head of Highways &
Public Protection, in conjunction with the Chief Legal and
Democratic Officer be authorised to adopt areas of highway pursuant
to section 228 of the Highways Act 1980, as detailed within the
report and shown upon the attached plans: -

Cambridge Gardens, Southport – An area of
footpath adjacent to no.92 Cambridge Gardens. As shown on the
attached plan DC2258;
·
Drummond Road, Crosby – A section of the
existing carriageway and footway on Drummond Road, from adjacent to
no. 9 Edgemoor Close to the entrance of the Liverpool County FA
site. As shown on the attached plan DC2257;
·
Nevill Street, Southport – An area of footway
adjacent to nos. 42-66 Nevill Street. As shown on the attached plan
DC2259;
·
Park View, Thornton – An existing section of
footway adjacent to no.24 Park View and the private access road to
nos.71 & 73 Southport Road. As shown on the attached plan
DC2260.
·
Marsh Lane/Rimrose Road (A565) – An area of
footway and soft landscaping adjacent to the junction of Marsh
Lane/Rimrose Road (A565) which runs along the rear of properties on
Ronan Close and Talisman Way. As shown on the attached plan DC2261.
·
To adopt an area of soft landscaping opposite
properties 5-23 (odds) & 6-12 (evens) Beatty Road. As shown on
the attached plan DC2262.
·
To adopt a section of footpath and soft landscaping
fronting properties 2-10 (evens) Briar Road. As shown on the
attached plan DC2263.
Reasons for the Decision(s):
Cabinet Member authorisation is required in
order to allow the Local Authority to legally “adopt”
and therefore maintain areas of highway which do not form part of
the adopted highway network at the present time, under legislation
contained within Section 228 Highways Act 1980.
