Purpose

This report relates to the non charity land
part of Tinsley Park Golf Club and to Springs Leisure Centre.
The leisure operating contract provides for
the grant of leases of Tinsley Park Golf Club and Springs Leisure
Centre to Sports and Leisure Management Ltd, who is permitted to
grant a sublease to SLM Community Leisure Charitable Trust
(“SLM”). The parties are not yet in a position
to grant the leases (and therefore the subleases to SLM), so in
late 2024 tenancies
at will were instead proposed.
The December 2024 decision agreed for the
Council to enter into tenancies at will with Sports and Leisure
Management Ltd. However, following mobilisation, the operator has
requested that the tenancies at will are instead entered into with
its charitable trust, SLM.
Part of Tinsley Park Golf Club sits with the
charity High Hazels Park (charity registration number 1183830) and
the Charity Trustee Sub-Committee on 23rd June 2025
granted authority for a tenancy of will with SLM.

1. Note the decision of the Charity Trustee
Sub-Committee on 23rd June 2025 to enter
into a tenancy at will of Tinsley Park Golf Club (part of
which sits with the charity High Hazels Park) with SLM Community
Leisure Charitable Trust (“SLM”).
2. Approve entry by the Council into a tenancy
at will in relation to the non[1]charity land part of
Tinsley Park Golf Club with SLM.
3. Approve entry by the Council into a tenancy
at will of Springs Leisure Centre with SLM.

Reasons for the decision

This decision will ensure that the tenancies
at will be entered into with SLM, which will assist SLM in
delivering the required services at these facilities.

Alternative options considered

Alternative Option 1 – Not enter into tenancies at will with SLM for Tinsley
Golf Course and Springs Leisure Centre. This option was discounted
because the operator’s financial model is based on SLM
operating the sites and to do so, they need a legal right to occupy
the properties.
 
Alternative Option 2 – wait until the
parties are ready to grant the leases This is not a viable option
for the parties, who need to regularise the property arrangements
at the sites as soon as possible so that SLM have a legal right to
occupy.
