10.1
The Business
Manager for Parks and Countryside introduced the report which asked
the committee to consider the contents of the report and grant
approval to an extension of the lease of the park
café.
10.2
RESOLVED
UNANIMOUSLY: That the Charity Trustee
Sub-Committee:-
a)
Approve the grant of a lease for a term of 2 years to the existing
café tenant at the end of the current
lease.
b)
Authorise the Head of Property Services to offer the property to
the market during 2026 and identify potential
operators.
c)
Note that a recommendation will be brought back to the committee as
to the results of the tender process and to seek approval to enter
into a lease arrangement with the recommended
operator.

Reasons for
Decision
10.3.1
The proposal to grant a further lease of this
café facility:
·
Safeguards the café facility at Endcliffe Park for the short
term.
·
Secures an increased income stream by way of rent and contribution
to running costs of the Park.
·
Enhances the attractiveness of the park as a valuable asset for use
by the community.
·
Enables the demised property to be occupied for the purposes of the
charitable objects of the Charity.
·
Assists the process of selecting an operator for the Pavilion and
Lodge.
·
Complies with the provisos contained within the power granted to
the Trustee by the 1888 Conveyance and with the statutory
provisions contained within the CA 2011 and ToLaTA 1996 and further
with the requirements of the Charity Commission

Considered and Rejected
10.4.1
Alternative Option
1:
Go out to the market now to
identify potential interest. This would make it difficult to assess
the outcome of the Pavilion and Lodge marketing process and may
compromise the situation.
