The Committee considered a report of the Executive Director of Neighbourhood Services requesting confirmation that Weston Park Trust acknowledges and accepts that a legacy referenced in the latest Will of a deceased individual was not intended for the Trust and agrees that the intended beneficiary is Weston Park Cancer Hospital.

RESOLVED UNANIMOUSLY: That the Charity Trustee Sub-Committee Committee:-

(a)  Confirms that Weston Park Trust acknowledges and accepts that the legacy referred to in the Will of the deceased was not intended for Weston Park Trust;

(b)  Agrees that the intended beneficiary of the legacy is Weston Park Cancer Hospital, as set out in the solicitor’s correspondence;

(c)  Delegates authority to the General Counsel to provide written confirmation to the estate’s solicitors (as per CLOSED Appendix B) and to execute any associated documentation required to give effect to this position, where necessary.

Reasons for Decision

Approving this proposal ensures that Weston Park Trust acts transparently, lawfully and in accordance with the clearly evidenced wishes of the donor. It also provides a clear audit trail linking this report to the previous report considered by the Charity Trustee Committee on 8 April 2026 under item 71, where the matter was discussed and a decision was taken. The proposed approach avoids the Trust benefiting from a legacy that was not intended for it, thereby protecting the integrity of the charity and supporting proper administration of the estate in line with charity law principles and trustee responsibilities.

Alternatives Considered and Rejected

  1. 4.1

Alternative Option 1: Contact solicitors to suggest the legacy may have been intended for the Weston Park Charity

An alternative option would be to not respond to the request from the solicitors. However, this would potentially lead to the Trust benefiting from a legacy that was not intended for it and therefore compromise the integrity of the charity. For these reasons, this option has been rejected.
