Reasons for the decision
The Council needs to meet its obligations under the requirements of Regulatory Reform [Fire Safety] Order 2005, Housing Act 2004, and Housing Fire Safety [LACoRs]. Following an open tender process (which is fully compliant with UK procurement rules), whilst there were 25 expressions of interest received, due to the complex nature of the works only one tender was received.
Alternative options considered
Option 1 - Do nothing. This is not considered a viable option as the works identified following a recent fire risk assessment are deemed essential. Therefore, the Council will not meet its obligations under the requirements of Regulatory Reform [Fire Safety] Order 2005, Housing Act 2004, and Housing Fire Safety [LACoRs] or carry out the remedial works as stipulated within a recent fire risk assessment for all three locations. Option not recommended.
Option 2– Undertake a further tender exercise. In the last tender programme, which was advertised in “Contracts finder” thirty-six local and national contractors were contacted directly and advised of this opportunity. Twenty-five expressions of interest were received by PSPS. Of these expressions of interest four contractors undertook site visits to evaluate the scope of the required works. However, only one tender was submitted.
Due to the complex nature of the proposed works and the abundance of opportunities within the market. It is not considered that a further round of tendering would enhance the number of contractors bidding for this work. Option not recommended.
