Purpose
To approve the highway
improvements on Horselydown Lane as
detailed in the report, instruct officers to
make the necessary Traffic Management Orders and to authorise officers to take steps to hold a public inquiry pursuant to
regulation 9(1) of the 1996 Regulations in relation to the proposed
TMOs if considered expedient to do so.
Decision
RESOLVED:
1.
That the highway
improvements on Horselydown Lane as
detailed in Appendix 1 of the report and summarised in Table 1, implemented by way of powers
under the Highways Act 1980 (“1980 Act”) and orders
made under the Road Traffic Regulation Act (“1984 Act”)
be approved, subject to the outcome of any necessary statutory
consultation and procedures.
2.
That officers be
instructed to make the necessary Traffic Management Orders
(“TMOs”) in accordance with sections 6 and 124 (and the
other relevant powers identified in the report) of the 1984 Act
subject to statutory consultation carried out pursuant to the Local
Authorities Traffic Orders (Procedure) (England and Wales)
Regulations 1996 (“1996 Regulations”).
3.
That the
cabinet member
considered the equalities assessment set out in this
report in accordance with the council’s Public Sector Equality Duty
(“PSED”).
4.
That it be noted that
officers will present a further report to the cabinet member should
the council
receive any objections (that are not subsequently
withdrawn) during statutory consultation.
5.
That officers be
authorised to take steps to hold a
public inquiry pursuant to regulation 9(1) of the 1996 Regulations
in relation to the proposed TMOs if considered expedient to do
so.
