Purpose
To
consider the Experimental Traffic Management Order (ETMO)
consultation undertaken.
Decision
1.
That the
Experimental Traffic Management Order (ETMO) statutory consultation
and the subsequent non-statutory consultation undertaken by Lambeth
Council as lead council on the closure of a borough boundary road,
The Cut between Short Street and Hatfields be
considered.
2.
That Lambeth Council’s
approved officer delegated decision report and
appendicesin respect of The Cut between
Short Street and Hatfields found in
Appendix 1 be noted and that the public responses and objections
received during the operation of the ETMO noted therein be
considered.
3.
That the performance
of the ETMO be considered and that Lambeth Council be authorised to
give permanent effect the ETMO on The Cut between Short Street and
Hatfields in consultation with officers
of the council under the provisions of section 124, Schedule 1 and
Part IV of Schedule 9 of the Road Traffic Regulation Act (RTRA)
1984 and of the Local Authorities’ Traffic Orders (Procedure)
(England and Wales) Regulations 1996 Regulations 23 and
24.
4.
That officers be
authorised to work with Lambeth on the progression of a modal
filter with restricted access and an area of greening on
Ufford Street (borough boundary) and a
modal filter on Webber St (Lambeth section) and make the
Order.
5.
That officers be authorised to liaise
with Lambeth Council to make the necessary permanent Traffic
Management Order (TMO) on Southwark’s behalf to implement the
proposals on Ufford Street following
statutory consultation under the Local Authorities Traffic Orders
(Procedure)(England and Wales) Regulations 1996.
6.
That the Equality
Impact Assessment prepared for the purposes of this report,
encapsulating the existing experimental schemes and proposed new
restrictions (Appendix 1) be noted.
7.
That subject to
the above approval at recommendation 5 regardingUfford Street, and having due regard to the outcome
of the consultation referred above, the implementation of these
measures be agreed under sections 6, 45, 46, 49 and 124 of and Part
IV of Schedule 9 to the Road Traffic Regulation Act
1984.
8.
That it be agreed that where
material objections are received during the consultation referred
to at recommendation 5 in respect of
Ufford Street above and having due
regard to the implementation of the measures under sections 6, 45,
46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic
Regulation Act 1984 authorises that these are considered by Lambeth
Council following consultation with officers of the council, before
a decision is reached on whether or not any of the proposals will
be implemented.
9.
That Lambeth be authorised to
exercise discretion not to hold a public inquiry related to the
proposed Permanent Traffic Order in respect of Ufford Street, and that the responses received,
including objections to the proposals of, do not warrant the
holding of a public inquiry pursuant to Regulation 9 of the Local
Authorities Traffic Orders (Procedure) (England and Wales)
Regulations 1996.
10.
That the exchange
of letters under Section 9EA of the Local Government Act 2000 be
authorised in accordance with the Local Government (Arrangements
for the Discharge of Functions) (England) Regulations 2012 to allow
Lambeth to make the ETMO on The Cut permanent and make the TMO on
Ufford Street if
appropriate.
