Decision

That the Cabinet Member for
Clean Air, Streets and
Waste;
 
1. 
Instructs officers to
proceed to the detailed design stage for the Streetspace Planter Replacement at Cooks Road.
Cooks Road Improvements taking into consideration amendments in
paragraphs 26 - 36 and following feedback from the consultation
process.
2. 
Authorises officers to
proceed to implement the Cooks Road Improvements by way of powers
under the Highways Act 1980 (“1980 Act”), and permanent
Traffic Management Orders (“TMOs”) made pursuant to
sections 6 and 124 (and otherpowers) of
the Road Traffic Regulation Act (“1984 Act”), subject
to statutory consultation carried out in accordance with the Local
Authorities Traffic Orders (Procedure) (England and Wales)
Regulations 1996 (“1996 Regulations”).
3. 
Authorises officers to
undertake the required statutory consultation and associated
procedures under the relevant sections of the 1980 Act and the 1984
Act, where applicable, to deliver the Cooks Road
Improvements.
4. 
Notes that if
objections to the TMOs for the Cooks Road Improvements are received
during the statutory consultation period, a further report will be
brought forward for consideration and decision by the Cabinet
Member.
5. 
Authorises officers to
take steps to hold a public inquiry pursuant to regulation 9(1) of
the 1996 Regulations in relation to the proposed TMOs if considered
expedient to do so.
