Purpose

Carole Lesley Melia (the Tenant) currently occupies Ollier House, by way of a 99-year ground Lease.  With 58 years remaining.

The Tenant has written to the Council requiring consent to Sublet the demised space to Kids Zone Nursery Group Ltd for a term of 15 years, commencing on completion of the licence to sublet.  The Lease requires the Tenant to obtain the Councils written consent (which is not to be unreasonably withheld) to a Sublet.

The Tenant is responsible for the Councils Legal and Surveyors fees.

Decision

To be given approval for a Licence to Sublet as requested. 

Reasons for the decision

To comply with the terms of the Lease.

Alternative options considered

Reject: If rejected this will be a breach in covenant and the Council would be acting unreasonably.
