Purpose

Dane Bank Green Space CIO currently lease the property known as Dane Bank Green Space on a 25-year term commencing 13 July 2021.

Dane Bank Green Space sublet various areas of the site to four subtenants.  These are:

(i)      Kids Go Wild

(ii)    Dane Bank Angling Club

(iii)  Dane Bank Green Space Community Group

(iv)  Tameside’s People 4 Wildlife

Dane Bank Green Space CIO is seeking to grant a new lease to Kids Go Wild, who will be taking on an additional area of the site.

The Tenant has written to the council seeking consent to underlet to Kids Go Wild.  The lease requires the Tenant to obtain the council’s written consent, which is not to be unreasonably withheld.

The Tenant is to be responsible for the Councils Legal and Surveyors fees.

Decision

That approval was given to provide a Licence to Underlet for Kids Go Wild.

Reasons for the decision

To comply with the terms of the lease.

Alternative options considered

If this were rejected the Council would be considered acting unreasonably and may be subject to legal challenge.
