Purpose

The report sought to set out the details of the planning application, the S106 agreement, and why delegated authority was required in order for the S106 agreement to be signed.

Decision

That approval be given for the Council to enter into the S106 agreement.

Reasons for the decision

Planning application 25/00994/FUL seeks permission for the erection of 4 no covered padel courts and associated club house, car parking and seating areas.

The planning application is to be recommended for approval, subject to conditions and a S106 agreement.  The S106 agreement is required to recoup the costs for the biodiversity monitoring, associated with achieving the mandatory 10% biodiversity net gain, that will be carried out by the Greater Manchester Ecology Unit (GMEU).

It was not necessary for the planning application to be determined by members of the Speakers Panel (Planning) and so delegated authority is required from the Director of Strategic Growth, to give agreement to the Council entering into the S106 agreement.

Alternative options considered

Failure to grant delegated authority for the Council to enter into, and complete, the S106 Agreement would prevent the effective monitoring, management and long-term delivery of the proposed on-site biodiversity net gain measures.  Consequently, the development would fail to secure adequate mechanisms for ensuring that biodiversity enhancements are maintained and monitored in accordance with the objectives of Policy N2 of the National Planning Policy Framework and Policy JP-G8 of Places for Everyone.
