Decision

That it be DETERMINED that:

  1. Approval is given to allocate the sum of £56,820 for Variation Order VO-05.  This is an amendment to the boundary fencing at the new Hawthorns SEND school which will enable an area of Public Open Space extending to 0.6 hectares (1.6 acres) be returned to public access, as well as providing more effective security to the school estate.  The cost of the fencing will be jointly funded by the school and Council.  The total cost of £56,820 includes a 5% contingency.  The school will re-imburse the Council for their share of the fence costs in the sum of £16,498.  The net cost to be paid by the Council of £40,322, including contingency will be funded from unallocated S106 Public Open Space allocations.
  2. Any spend against the remaining budget will be monitored through the Strategic Planning and Capital Monitoring Panel (SP&CMP).
  3. Approval be given for the Council to enter into a Legal Indemnity with the Newbridge Multi-Academy Trust to reimburse the Council for their proportion of the costs totalling £16,498.

Reasons for the decision

To provide an element of Public Open Space for the amenity of local residents and to provide additional security to the school estate.
