Urgent decision – Pavement Licence Fees

Purpose

On 3 September 2024, the Community Services
Committee considered a report alongside the Levelling Up &
Regeneration Act 2023 (LURA2023), and Guidance issued by the
Department of Levelling Up, Housing & Communities to determine
the fees to be charged for the Grant and Renewal of a Pavement
Licence.

Under Schedule 22 of the LURA2023, the application fee for the
grant of a pavement licence that a local authority may charge is a
maximum of £500. The application fee for the Renewal of a
pavement licence that a local authority may charge is a maximum of
£350. Each authority has discretion to set its fees up to the
maximum allowable.

Previously, the fee to be charged was set by the Government to aid
business following the pandemic and was set at £100. This did
not cover the cost to the authority for dealing with and processing
an application for a pavement licence and then enforcement of the
licence.

This urgency decision sets a fee in relation to the grant and
renewal of a Pavement Licence, in the absence of an agreed fee at
Community Services Committee on 3rd September. It takes account of
the Council's Medium-Term Financial position considered by the
Strategy & Resources Committee on 26 September 2024, and a
number of principles recommended by the Committee to Full Council
for adoption to provide a sustainable Medium-Term Financial
Strategy.

Decision

1) The fee for the Grant of a Pavement Licence
be set at £500 and that the fee for the Renewal of a Pavement
Licence be set at £350.

2) The £350 renewal fee will be implemented from 1st January
2025, with the price held at £200 for a two-year licence
(equivalent to £100 per year) until 31st December 2024.
