Purpose

The Warburton Neighbourhood
Development Plan prepared by Warburton Parish Council has been
submitted to Trafford Council and the Council is required to
support next stages of the Neighbourhood Planning
process.
 
The first step is for the
Council to publicise the Plan under Regulation 16 of the
Neighbourhood Planning (General) Regulations 2012 (as amended by)
The Neighbourhood Planning (General) (Amendment) Regulations
2015.

Decision

1.         
That the Corporate Director of Place be delegated
authority to carry out public consultation in respect of the
Warburton Neighbourhood Development Plan in accordance with
Regulation 16 of the Neighbourhood Planning (General) Regulations
2012 (as amended by) The Neighbourhood Planning (General)
(Amendment) Regulations 2015 and in accordance with section 6 of
the report.

 
2.         
That the Corporate Director of Place be delegated
authority to organise and make all necessary arrangements for the
Examination into the Plan following the closure of the Regulation
16 public consultation period.
 
3.         
That the Corporate Director of Place be delegated
authority for the preparation and issuing of the Council’s
proposed response to the Regulation 16 consultation, covering the
issues raised in section 5 of the report.
 
4.         
That it be noted that the Council has secured
Neighbourhood Planning Grant funding of £15,000 to cover the
cost of the Warburton Neighbourhood Development Plan consultation
and examination.

Reasons for the decision

Approval is sought to delegate
authority to the Director of Growth and Regulatory Services in
respect of the organisation of the Warburton Neighbourhood
Development Plan public consultation, under Regulation 16 of the
Neighbourhood Planning (General) Regulations 2012 (as amended by)
The Neighbourhood Planning (General) (Amendment) Regulations 2015,
and the Examination, and the Council’s response to the
submitted version of the Plan. This delegation is to ensure that
the necessary authority exists throughout the next stages of Plan
preparation, in order that momentum is not lost in respect of
preparing the Plan.

Alternative options considered

Under the Town and Country
Planning Act 1990 (as amended), the Council has a statutory duty to
assist communities in the preparation of neighbourhood development
plans and to take plans through a process of examination and
referendum, therefore, to not take forward the Plan would be
contrary to the Regulations.
