Purpose
A
Definitive Map Modification Order application under s53(5) of the
Wildlife and Countryside Act 1981 has been made to the Council and
evidence has been produced claiming that a circular route on land
in Hale to the south of Bankhall Lane with entrances off Bankhall
Lane (3 no) and off footpath no 3, Hale (2no) have been used by the
public as footpath as of right, uninterrupted, unhindered for a
period of twenty years or more.
Decision
1.
That the Council on the basis
of the available evidence and for the reasons set out in the
report do not make an Order under section 53(2)(b) of the Wildlife
and Countryside Act 1981 to add the routes referred to in this
report to the Definitive Map and Statement as footpath.
2.
That the applicant and landowners are notified in
writing of the decision, and that there is a right of appeal
procedure to the Secretary of State for a review of the
decision.
