Purpose
Employee A has been employed by the Council since 21 June
2016.
Having reviewed the situation and looked at the
costs/benefits the Joint Assistant Director for People & OD has
decided a severance payment to settle this matter is beneficial to
the Council. The value of the
Settlement Agreement is £19,999.00 with an additional
£750.00 to support with legal costs. The £19,999 is not subject to tax and
national insurance contributions. The
settlement payment of £19,999 does not include pay in lieu of
notice.

Approval under the scheme of delegated
authority by the Assistant Director, People & Organisational
Development for a severance payment of £19,999.00, with an
additional £750.00 to support with legal costs to a member of
staff to end their employment.
Reasons for the decision
The decision represents best value for the
Council. It provides a cost-effective
resolution and Employee A will have no ability to challenge the
Council at an employment tribunal in respect of their
performance. This therefore reduces any
risks to the Council.
Alternative options considered
Not to settle with Employee A.
This would have left the Council exposed to a potential claim at an
Employment Tribunal.
Employee A would have remained employed and underperforming
with an impact on the quality of service delivery.
