Purpose
As part of the delivery
of the A29 phase 1 realignment, West Sussex County Council
(WSCC) and CC Projects (CCP) will be entering a legal agreement for
the demolition of the Fleurie Nursery Greenhouses and ancillary
buildings to commence the A29 phase 1 planning permission and to
clear the nursery site for future development. The Works Licence includes for CCP to reimburse
WSCC through an agreed scope of works and quotations provided by
Jackson Civil Engineering and their sub-contractor who will be
carrying out the works.
It is now urgent that WSCC
completes the licences and the demolition commences in
March. The demolition forms part of the A29 phase 1 planning
commencement, which has to be achieved by 30 June 2024. If it
isn’t, the scheme will not retain its planning permission
(which was for three years) and there are no other opportunities to
undertake other aspects of the work as no land has yet been
dedicated to WSCC to undertake a substantive start that would allow
for WSCC’s planning team to provide a lawful commencement
certificate and thus retain the phase 1 planning
permission.
Due to the need for this matter
to be determined as soon as possible the decision maker has secured
agreement from the appropriate Scrutiny Chairman for this key
decision to be taken without prior notice in the Forward Plan of
key decisions [Part 4, Section 1, Standing Order 3.57 (Regulation
11)] because delay would prejudice the County Council’s
interests.
Decision
The Assistant Director (Highways, Transport
and Planning) has approved –
an additional capital allocation of
£67k for the A29 phase 1 realignment; and
a Works Licence for West Sussex
County Council to undertake demolition works on CC Projects Land at
a cost of £557k.
