Purpose

West Sussex County Council
(WSCC) currently holds an interest in Maidenbower Day Centre,
Harvest Road, Maidenbower, Crawley, West Sussex, RH10 7RA. It is
proposed the County Council enters into a lease with Crawley
Borough Council for this property and then grants a sub-lease of
the same to Dimensions (UK) Ltd. 
 
The freehold of the property is
owned by Crawley Borough Council (CBC). The Day Centre forms part
of a larger property which includes Maidenbower Community Centre
and a nursery.  The Day Centre side of
the property has been occupied by WSCC since the whole premises was
constructed by the County Council in 1996. The terms of the
occupation have until now been set out in a 60-year agreement dated
10 December 1996 between Crawley Borough Council and
WSCC.
 
The Adults Day Centre was
vacated in 2019 following the Adults Services Choices for the
Future programme. Due to use restrictions in the user clauses of
the 1996 agreement, finding suitable alternative uses for the
former Adults Day Centre has been challenging.  To regularise the position CBC will grant WSCC a
50 lease of the property which will grant WSCC a right to sub-let
the property.
 

Decision

The Cabinet Member for Finance and Property
approves that –
 

(1)    
the County Council enters into a
lease (the Head-lease) of the Maidenbower Day Centre, Harvest Road,
Maidenbower, Crawley, West Sussex, RH10 7RA subject to agreement
and final terms, for a term of 50-years, as set out in the attached
plan Appendix B; and

 

(2)    
on completion of the Head-lease the County Council grants a
sub-lease of Maidenbower Day Centre, Harvest Road, Maidenbower,
Crawley, West Sussex, RH10 7RA to Dimensions (UK) Ltd, subject to
agreement and final terms for a term of five years (more details
in Appendix A restricted for members only); and

 

(3)    
Authority is delegated to the Director of Property and Assets in
conjunction with the Director of Law and Assurance to negotiate,
agree and conclude the terms of the lease and the sub-lease.
