Purpose

Under the Town and Country
Planning Act 1990, for a cross boundary application, the County
Council is the determining authority for the planning application
on land outside the boundary of a national park.  Mid Sussex District Council
is granted authority under Section 101 of the Local Government Act
to discharge the County Council’s functions and to determine planning application DM/24/1355 in relation
to the part of the site that lies outside of the
South Downs National Park, and, should
planning permission be granted, any future planning application/s
related to the same development.  This
is because they have already registered the application, have
background knowledge of the proposals, the planning history of the
site, and relevant expertise in planning matters for residential
development.
 
Due to the need for this matter to be
determined as soon as possible, the decision maker has secured
agreement from the Chairman of Planning and Rights
of Way Committee and the Assistant Director (Highways, Transport
and Planning), for which they have both given approval, as
per the West Sussex County Council Constitution - Part 4, Section
1, Standing Order 3.45.
 
The reasons for urgency is because the
referenced residential planning application has been filed and is
ready to be considered and the delegation to the local planning
authority should not await the convening of the County
Council’s Planning and Rights of Way Committee. The
delegation does not include any consideration of the substance of
the planning application. The reasons for the delegation are set
out in the report.

Decision

The Director of Law and
Assurance has approved the decision that West Sussex County Council
authorises Mid Sussex District Council to discharge the County
Council’s planning functions in relation to the current
planning application DM/24/1355 and any
future related planning application/s for the part of the proposed
development site that lies outside the South Downs National Park.
