Purpose

The Anti-social Behaviour, Crime and Policing Act 2014 (the Act)
introduced an absolute ground for possession to expedite the
eviction of the most anti-social tenants.

The absolute ground for possession is inserted into the Housing Act
1985 (at section 84A).

Where the absolute ground is relied upon, the court must grant
possession, provided the landlord has followed the correct
procedure.

The ASB – Absolute Ground for Possession Guidance and
Procedure sets out the procedure that will be adopted by Wigan
Council in such cases.

Decision requested is to accept the ASB – Absolute Ground for
Possession Guidance and Procedure document as the ‘correct
procedure’ for Wigan Council.
