Purpose

Ground and construction works for the Galleries redevelopment
project.

Decision

The Director of Place:

 

(1)      
approves, in accordance with the terms of a development
agreement made between the Wigan Borough Council and
Cityheart Limited dated 25 June 2021, the Galleries
Building Contract Framework (the Building Contract) in
substantially the form attached to this
report; 

(2)      
authorises entry into the development funding agreement in
respect of Section 0 works described within the report, in
substantially the form attached to this report;

(3)      
authorises entry into the Building licence, in substantially
the form attached to this report for the purposes of carrying out
the works described therein;

(4)      
authorises entry into the Licence to Alter
relating to The Marketgate Shopping Centre
Marketplace and 38 Marketplace, Wigan, in substantially the form
attached to this report;

(5)      
authorises entry into any agreements either ancillary or
collateral to the Building Contract and the documents referred to
at 2, 3 and 4 above to facilitate the delivery of the works
described in the report, including but not limited to, any
warranties, forms of appointment and performance security
arrangements; and

(6)      
delegates authority to The Assistant Director – Legal,
Governance and Elections to enter into all agreements necessary on
behalf on the Council, to facilitate the above.
