Purpose

Section 1 and
2a construction works for the Galleries redevelopment
project.

Decision

The Director of Place authorises pursuant to
the delegated authority given by the Cabinet decision dated
20th
February 2025 to:
 

(1)    
in accordance with the terms of
the Development Agreement made between the Wigan Borough Council
and Cityheart Limited dated 25 June 2021 (as varied), approves the
deed of variation for Section 1 of the Galleries Building Contract
Framework between Cityheart and Galliford Try in the substantive
form attached to this report;

(2)    
entry into the Section 1
Development Funding Agreement in respect of the Section 1 works in
the substantive form attached to this report;

(3)    
entry into the Building Licence
for Section 1 in the substantive form attached to this
report

(4)    
approve and authorise entry into
the Agreement for Lease for the New Market Hall in substantive form
attached to this report together with any documents or agreements
either ancillary or pursuant to the Agreement for Lease including
but not limited to the Market Charter Licence and the Market
Operator Management Agreement;

(5)    
in accordance with the terms of
the Development Agreement made between the Wigan Borough Council
and Cityheart Limited dated 25 June 2021 (as varied), approves the
deed of variation for Section 2a of the Galleries Building Contract
Framework between Cityheart and Galliford Try in the substantive
form attached to this report;

(6)    
entry into the Development Funding
Agreement for Section 2a in respect of the Section 2a works in the
substantive form attached to the report;

(7)    
entry into the Building Licence
for Section 2a in the substantive form attached to this report;
and

(8)    
delegated authority to the
Assistant Director – Legal, Governance and Elections to enter
into all agreements necessary on behalf on the Council, to
facilitate the above.
