Purpose

Section 2 and 3 construction works
for the Galleries redevelopment project.  

Decision

The Director
– Place, in consultation with the Executive Leader (Portfolio
Holder for Economic Development and Regeneration) and the Assistant
Director – Legal, Governance and Elections (pursuant to the
authority delegated by the Cabinet decision dated
31st July 2025
– minute refers 31), authorises:-
 

(1) 
the variation of the Building Contract (on the terms of the
document attached to this report at Attachments 3 and 6) to
incorporate Sections 2 and 3 of the project;

(2) 
the completion of the Development Funding Agreement (on the
terms of the document attached to this report at Attachments 1 and
4) relating to Section 2 and Section 3 of the project;

(3) 
completion of the Building Licence Agreement (on the terms of
the document attached to this report at Attachments 2 and 5) to
facilitate the works constituting Sections 2 and 3 of the
project;

(4) 
completion of the Hotel Management Agreement (on the terms of
the document attached to this report at Attachment 7);

(5) 
the Addendum to the Hotel Franchise Agreement (on the terms
of the document attached to this report at Attachment
8);

(6) 
entry into any documents either pursuant or ancillary to the
documents referenced in 1 to 5 above, including but not limited to,
any Warranties and/or Professional Appointments; and

(7) 
the Assistant Director – Legal, Governance and
Elections to enter into all agreements necessary on behalf on the
Council, to facilitate the above.
