Purpose
In line with the Community Asset Transfer
Policy, approved by full Council on 8 February 2024, the Portfolio
holder for Communities can approve decisions relating to the
transfer of community assets. Cllr Steve Greentree as executive
member for Communities is exercising the delegated authority.
Content
The previous decision to transfer The Maybury
Centre to the Maybury Centre Trust dayed 13 June is here by
rescinded. The Strategic Director - Communities, in consultation
with the Portfolio Holder for Communities, is authorised to take
all necessary steps to effect this decision, including
communication with stakeholders and updating relevant
records.
Reasons for the decision
Following recent events at The Maybury Centre,
including the removal of gas and electricity meters by the utility
provider, the Council has serious concerns around the Maybury
Centre Trust's suitability for the transfer. The Trust has not
provided the requested clarification in response to these matters,
including evidence to explain the removal of both the gas and
electricity meters from the Maybury Centre. The omission raises
serious concerns for the Council regarding the ongoing safety of
the building and the Trust's ability to manager the site
appropriately. These actions are incompatible with the principles
and openness , accountability and partnership that underpin the CAT
policy process. Ref Section 4.4 of the CAT Policy. "A CAT would not
be transferred where a community organisation has breached
confidentiality, or is acting in a way that is not open,
transparent or is intentionally misguiding the Council.
Alternative options considered
Option 1 - For the Maybury Centre Trust to
proceed with the transfer. The Risks considered are too high.
