Content: Salford City Council - Record of Decision   Title: GM Clean Air Plan - Regent Road Local Measures Moving Traffic Offences   I Councillor Jack Youd, Deputy City Mayor and Lead Member for Finance, Support Services and Regeneration, in exercise of the powers contained within the City Council Constitution do hereby approve the introduction of Moving Traffic Offence enforcement cameras at sites on Regent Road and Trinity Way to support the Greater Manchester Clean Air Plan.   The Reasons are:   The City Council have been working with TfGM and the Greater Manchester Districts to gain approval for an Investment Led Clean Air Plan, rather than the previously approved charging Clean Air Zone across the region. As well as investment in new buses and taxis, there are a limited number of local measures required in Salford and Manchester. This includes a 30mph speed limit and adjustments to traffic signals on Regent Road as well as some local highway measures in the St Johns area of Manchester City Centre. The modelled results indicate delivering compliance in air quality terms, with the Government agreeing with the results and supporting the Investment Led Plan in January 2025. To ensure the modelled results are reflected on the network, compliance with the speed limit and other restrictions in place need to be enforced.   The proposal at Regent Road and Trinity Way is to carry out enforcement of the yellow boxes to increase compliance and ensure, insofar as possible, that the network operates as modelled and delivers the modelled outcomes in air quality terms.     Options considered and rejected were: take no action     Assessment of Risk: There is limited risk from this project as it is fully funded from GMCAP including the provision of the cameras and operational costs.       The source of funding is: GMCA Clean Air Plan funding   Legal Advice obtained: Shared Legal Service and Rob Owen - Head of Highways and Network Management   The Civil Enforcement of Moving Traffic Contraventions Designation Order 2023 devolved civil enforcement powers  for some moving traffic offences to those Local Authorities named in the Act. The Act also specifies the area within the Local Authority to which this applies.   Salford City Council are included and the designated area is  defined as ‘  the part of the area of Salford City Council designated as a civil enforcement area for parking contraventions and as a special enforcement area by article 3(1) and 3(2)(c) (designation of civil enforcement areas and special enforcement areas under the Act) of,and Schedule 4 to, the Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) and Civil Enforcement of Parking Contraventions Designation (No. 2) Order 2012(39) as it had effect immediately before the relevant date;’   Part 4 of Schedule 7 of the Traffic Management Act 2004 defines the Moving Traffic Offences the désignation order permits to be enforced. It includes  offences under  s.36 Road Traffic Act 1988 and Chapter 5 of Traffic Signs and General Directions (TSGD) also says box junctions come under this section.   A Traffic Regulation Order is not needed to install yellow box markings but Chapter 5 of TSGD does say though that  the police should always be consulted.   Therefore so long as the proposed box junctions are within the designated area and are marked on the road in accordance with TSGD and the Police have been consulted there is minimal risk of any challenge to civil enforcement.
