The Licensing Sub-Committee of Wandsworth Council was scheduled to consider an application to vary a premises licence for Barmouth Kitchen. The application sought to extend the hours for the sale of alcohol and the playing of recorded music.
Barmouth Kitchen Premises Licence Variation
The main item scheduled for discussion was an application to vary the premises licence for Barmouth Kitchen, located at 2 Barmouth Road, London SW18 2DN. The applicant, Ryan Speed, sought to extend the hours for the sale of alcohol for consumption on and off the premises, and for the provision of recorded music.
Under the current licence, alcohol can be sold and recorded music played between 10:00 and 20:00 from Monday to Sunday. The proposed variation would extend these hours to 23:00 from Monday to Saturday, and to 22:30 on Sundays. The hours for other licensable activities, such as the opening of the premises to the public, would also be extended.
The report pack indicated that responsible authorities had not made any representations regarding the application. However, one representation was received from another person concerned about potential public nuisance, specifically an increase in noise from patrons and their children using the premises late at night. This representation related to the prevention of public nuisance
licensing objective.
The Sub-Committee was to consider the application in light of the Licensing Act 2003, which requires councils to promote four licensing objectives: the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm. The council's own Statement of Licensing Policy and the Government's Statutory Guidance were also to be taken into account.
The report pack outlined proposed conditions arising from the applicant's operating schedule. These included:
- No music to be played outside the premises.
- Clear notices to be displayed at all exits requesting patrons to leave quietly and respect local residents.
- A limit of 24 persons for outdoor dining seating.
- A restriction on unaccompanied children under 16 entering the premises when alcohol is being served for consumption on the premises.
The Sub-Committee was to decide whether to grant the application as requested, modify the conditions of the licence, or reject the application in whole or in part. Any decision would need to be appropriate for the promotion of the licensing objectives.
