Application for Review of Premises Licence for La Famiglia
The Licensing Sub-Committee was scheduled to consider an application for a review of the premises licence for La Famiglia, located at 5-7 Langton Street, London, SW10 0JL. The application was made by Mr Francesco Perticarari, a resident whose property adjoins the rear garden of the premises.
Mr Perticarari's grounds for review were the prevention of public nuisance and the protection of children from harm. He raised concerns regarding noise emanating from the use of the restaurant's rear garden and canopy area, stating that it affects his family's sleep and the peace of their home. He noted that the garden operates from approximately 07:00 until between 22:00 and midnight, generating noise from voices, laughter, cutlery, glassware, and service. Mr Perticarari referred to numerous complaints, officer attendances, warnings, and an Abatement Notice served by the Council's Noise and Nuisance Team, which he stated had not resolved the disturbance. He sought conditions to restrict customer use of the garden and canopy area to specific hours, prevent noise from being audible at neighbouring properties, require staff to supervise customer departures, and restrict furniture movement.
The report pack indicated that the Council's Environmental Health Department, represented by Mr Philip Richardson, submitted a representation in support of the review application. Mr Richardson detailed a history of complaints and officer visits dating back to February 2025, noting that prior to this, the premises operated with minimal complaints. The report detailed instances where officers considered noise levels to constitute a Statutory Noise Nuisance, leading to a warning letter and subsequently a Noise Abatement Notice served on the premises licence holder, Mrs Marietta Maccioni. Further complaints in 2026 led to a Fixed Penalty Notice being served for a breach of the Abatement Notice. Mr Richardson was seeking the imposition of specific conditions, including restricting customer use of the rear garden between 21:00 and 11:00 the following day, and prohibiting clearing of glasses or cleaning within the garden between 21:00 and 09:00.
In addition to the representations from Mr Perticarari and Mr Richardson, the licensing authority had received 247 representations in support of the premises. These included representations from Councillors Thalassites, Pascall, Rendall, and Taylor-Smith, and The Ten Acres Residents' Association. Supporters described La Famiglia as a long-established, independent, and family-run restaurant, an important part of the local character and community. Many supporters stated they had visited regularly for many years without experiencing excessive noise or disturbance.
The report pack also noted that at the time of writing, no response had been received from the Premises Licence Holder, Mrs Marietta Maccioni. The report outlined the steps the Committee could take, ranging from taking no further action to revoking the licence, all with a view to promoting the four licensing objectives: the prevention of crime and disorder, the prevention of public nuisance, public safety, and the protection of children from harm.
The meeting was scheduled to be held in public, with attendees entitled to address the Licensing Sub-Committee. The procedure to be followed was set out in a procedure document enclosed with the notice of the hearing.
