The Licensing Sub-Committee was scheduled to consider an application to vary the premises licence for The Prince of Peckham pub. The application included proposals to incorporate the basement into the licensed area and to remove existing conditions related to the use of the outside area.
The Prince of Peckham Premises Licence Variation
The Licensing Sub-Committee was scheduled to consider an application from The Arbuthnot Group Ltd to vary the premises licence for The Prince of Peckham, located at 1 Clayton Road, London SE15 5JA. The application proposed to add the basement level to the licensed area and to remove two specific conditions: condition 843, which limited the number of customers in the outside area to 20, and condition 850, which restricted the use of the outside area after 11 pm to a maximum of six smokers.
The report pack indicated that the application was referred to the sub-committee for determination due to representations received from responsible authorities and other persons. The Council's Environmental Protection Team (EPT) and the Licensing Authority submitted representations. The EPT objected to the removal of conditions 843 and 850, stating that these conditions were imposed to promote the licensing objective of preventing public nuisance and that their removal could lead to increased noise, disturbance to residents, and difficulties in managing customer dispersal. The Licensing Authority also raised concerns regarding the prevention of public nuisance and the prevention of crime and disorder, suggesting that the applicant's proposed Outside Management Plan might not be sufficient to promote these objectives. Both the EPT and the Licensing Authority had no objection to the inclusion of the basement area.
Four representations were also received from other persons, who are local residents. These individuals objected to the proposed removal of conditions 843 and 850, expressing concerns that this would lead to an increase in noise from patrons using the outside area and would adversely affect their quality of life. They highlighted existing issues with noise and congregation on the street after closing times.
The report pack also detailed the history of the premises licence, including previous variations and transfers. It outlined the provisions of the Licensing Act 2003, which requires licensing authorities to promote four licensing objectives: the prevention of crime and disorder, the promotion of public safety, the prevention of nuisance, and the protection of children from harm. The sub-committee was also to consider the council's Statement of Licensing Policy 2026-20311, which designates the premises as being within the Peckham Cumulative Impact Area (CIA)2. The report also noted the council's commitment to considering climate change implications, although this is not a direct licensing objective.
The meeting agenda also included standard procedural items such as receiving apologies, confirming voting members, notifying urgent items, and the disclosure of interests.
