This meeting was scheduled to discuss an application to vary the premises licence for The Legacy, a nightclub on Newport High Street.
The Legacy, 49 High Street, Newport
The Legacy's licence holder, Jack Bannister, applied to vary the club's licence to:
- Extend the hours during which it can sell alcohol for consumption on and off the premises from Monday to Sunday, 10am to 4am.
- Align the closing times for all licensable activities1 with the new time for the sale of alcohol.
The Licensing Authority initially objected to the application because the application conflicted with Newport City Council's Statement of Licensing Policy 2021. The policy states that:
New and variation applications for premises and club premises certificates within the “City Centre Stress” area will not be subject to the presumption of refusal, but operators will be expected to pay very special attention when drawing up their operating schedules and to make positive proposals to ensure that their operation will not add to the problems faced in these areas.
The Licensing Authority proposed to withdraw their objection if the applicant agreed to amend their application so that the terminal hour for the sale of alcohol on Sunday to Thursday was 3am, and 3:30am on Friday and Saturday. They also asked for the addition of a condition to the licence that there was to be no new entry or re-entry to the premises after 2am.
A member of the public, Van Tuan Tran of 48 High Street, objected on the grounds that it would have a detrimental effect on his tenants.
