This will lead to a huge increase in noise and low level disorder, as occurs when people get together late at night.

The selling and delivering of pizzas until 3am will lead to more litter on the street, as people discard the cardboard boxes and cups.

The increased noise from cars collecting pizzas and delivery vans will disturb the sleep of local residents - adult and children.

I am aware that Domino’s will not be selling alcohol, but it is extremely likely that people going to get a pizza between midnight and 3am are affected by alcohol already. The fact that Domino’s could be open will encourage people to gather there in an intoxicated state after most other premises have closed. This can lead to anti-social behaviour and thus make more work for police and ambulance services.

The applicants, LD4 Trading Ltd, the franchisee for this branch of Domino's, argue that the licence should be granted, because:

  • They have consulted with Cumbria Police and the Highways Agency, neither of whom have objected.
  • Domino's provides food to emergency service workers and care workers on night shifts.
  • Signage will encourage customers to leave the premises quietly.
  • They operate other late-night Domino's stores without incident, and continually monitor the situation.
  • The branch is covered by 24 hour CCTV.
  • The branch has a good record on crime and disorder.
  • The vast majority of orders after midnight are delivered, and the branch does not use delivery vans. Instead, two electric mopeds are used, which will not disturb residents.
  • The branch has a good record on litter, and will provide an external bin if necessary.
  • The branch has self-closing doors and toughened glass to prevent noise escaping.
  • The branch does not play music.
  • The branch will always have a trained and responsible key holder on site.

The Sub-Committee will need to decide whether to grant the application as it stands, or to grant it with modifications, in line with the licensing objectives of the Licensing Act 2003. These objectives are:

  • the prevention of crime and disorder;
  • public safety;
  • the prevention of public nuisance; and
  • the protection of children from harm.
