This meeting will consider three planning applications, one for full planning permission, one for reserved matters, and an outline planning application. The meeting will also receive an update on planning appeals in Wiltshire.
Land to West of Care Home (Former Divisional Police Headquarters), Wood Lane, Chippenham
The meeting will consider a full planning application for the development of 17 houses, including 7 affordable housing units. The application relates to a site to the west of Flowers Manor Care Home, that was previously granted permission for 8 dwellings in 2019. Objections have been received from Chippenham Town Council, the Environment Agency, and members of the public. Key issues to be considered include the scale of development, the visual impact on the surrounding area, design, and the potential for highway and environmental impacts. In particular the Town Council has raised concerns about the loss of trees and the overall design, stating that:
The architecture of the proposed development appears confused. It is neither traditional, like the adjoining Flowers Yard development, nor of a high quality contemporary architectural style.
The Town Council also questioned the necessity of two parking spaces per dwelling and highlighted the sustainable location of the development, within easy walking distance of the town centre.
Land Off Park Road, Malmesbury
The reserved matters for an outline application for up to 50 dwellings on land off Park Road, Malmesbury, will be discussed. A decision on this application had previously been deferred following a request from the committee to receive legal advice about their role in relation to the discharge of conditions related to access and flooding. In particular, concern had been raised about the implications of the site access via Park Road being subject to flooding. In response to those concerns the applicants have proposed an alternative emergency access route through a field to the west of the site, as well as surface water attenuation on site. The Environment Agency have advised that:
As the primary access on Park Road is known to flood to potentially unsafe depths and velocities, it is noted that the applicant is proposing an alternative access through the field outside of the redline boundary to the west of the site.
The Environment Agency also recommended that the Council consult with the emergency services about the suitability of the proposals. Legal advice from Guy Williams KC of Landmark Chambers has been submitted in response to the committee's request, which concluded that:
... there is no valid basis on which the reserved matters should be deferred or refused by reference to condition 12. If the reserved matters details are acceptable in terms of appearance, landscaping, layout and scale then they should be approved without delay given the timescales contained within the planning permission.
Malmesbury Town Council objects to the application, as does Councillor Gavin Grant. They have both highlighted the fact that the site is not allocated for development in the Malmesbury Neighbourhood Plan.
Land to the South West of The Street, Latton, Swindon
An outline planning application for a village recreation hall, all weather tennis court, parking, access and the erection of six houses on land to the south west of The Street, Latton will be considered. The application, which is a resubmission of a previously refused application, was previously resolved to be granted, subject to the completion of an archaeological field evaluation, the submission of a viability appraisal, and the completion of a Section 106 agreement. All three requirements have been fulfilled.
The Section 106 agreement proposed for this application sets out that land for a new village recreation hall will be transferred to Latton Parish Council. The Council's nominee will be the Latton Parish Community Trust, a registered charity. A financial contribution of £100,000 will also be made towards the construction of the new hall.
The application site is located outside the defined limits of development in the development plan, but Latton Parish Council supports the application.
