The Licensing, Environment & Safety Sub-Committee A met on Tuesday 25 February 2025 to consider an application for a premises licence for Liva, a lounge/bar at 6-8 Shaw Road, Heaton Moor, SK4 4AE. The committee granted the licence with revised operating hours and several conditions, following the withdrawal of objections from the Planning and Environmental Health departments.
Application for a Premises Licence at Liva
The Sub-Committee considered an application from Caani Restaurant Ltd for a premises licence for Liva, located at 6-8 Shaw Road, Heaton Moor. The application sought permission for the supply of alcohol (on and off the premises), late-night refreshments, and live and recorded music.
Initially, the Planning Department had raised objections regarding the proposed operating hours, stating they exceeded the hours previously approved under planning permission for a restaurant at the site. They also noted that planning permission did not exist for a lounge/bar (sui generis) use, and a change of use application would be required. The Environmental Health Department also raised concerns about potential public nuisance from noise and odours, particularly from live and recorded music after 11 pm, and noted that a noise management plan and customer dispersal policy had not been provided.
However, prior to the meeting, both the Planning and Environmental Health departments withdrew their objections following agreements with the applicant. The applicant, Caani Restaurant Ltd, agreed to reduce the hours for live and recorded music to 11 pm. This reduction meant that the provision of live and recorded music no longer required a licence. Further agreements included:
- No noise or odours emanating from extraction systems or mechanical devices that would cause nuisance to neighbouring properties.
- Signs to be placed at all exits encouraging customers to leave quietly and respect local residents.
- An operational dispersal policy and noise management plan to be in place.
- A senior member of staff to be on duty at all times when events are on.
- External doors and windows to be kept closed during amplified music or speech, except for access and egress.
- No noise emanating from the premises to cause nuisance to noise-sensitive properties in the vicinity.
- The premises to operate as a restaurant at all times, with hot, substantial food available whenever alcohol is sold after 8 pm.
During the meeting, the applicant further proposed reducing the hours for the supply of alcohol and late-night refreshments. The Sub-Committee, having considered these revised hours and the agreed conditions, determined that they were sufficient to address the prevention of public nuisance licensing objective.
The Sub-Committee resolved to grant the premises licence with the following hours:
- Supply of alcohol (on and off the premises):
- Sunday to Thursday: 7:00 am to 11:30 pm
- Friday to Saturday: 7:00 am to 12:00 am (midnight)
- Bank holidays: 7:00 am to 12:00 am (midnight)
- Provision of late night refreshments (indoors):
- Sunday to Thursday: 11:00 pm to 11:30 pm
- Friday to Saturday: 11:00 pm to 12:00 am (midnight)
- Bank holidays: 11:00 pm to 12:00 am (midnight)
The Sub-Committee was satisfied that no relevant representations had been raised concerning the licensing objectives of prevention of crime and disorder, protection of children from harm, and public safety. The meeting was attended by Councillor Dickie Davies (Chair), Councillor Shan Alexander, and Councillor Dean Fitzpatrick.
