Mr Philip Richardson, on behalf of the Environmental Health Noise & Nuisance team, objected on the grounds of public safety.

Following discussions with Mr Zomlot, Mr Richardson recommended operating the TEN from the conservatory into Acklam Road, subject to confirmation of the final plans of the street traders in Acklam Road. Mr Richardson raised concerns that the notice would undermine public safety because the location is near street trading stalls on Acklam Road, an area known for heavy congestion. He stated that the notice was likely to worsen congestion by drawing and holding people at the site, which could negatively affect crowd flow.

The sub-committee was reminded that it must consider the licensing objectives1 when determining the matter.

The sub-committee could take the following steps:

  • Issue a counter notice if it considers it necessary for the promotion of any of the licensing objectives to do so.
  • Take no action, and allow the notice to have effect.
  • If the premises has the benefit of a premises licence impose one or more conditions which are specified on the premises licence which the committee considers are not inconsistent with the carrying out of the licensable activities under the temporary event notice.
