The Kensington and Chelsea Licensing Sub-Committee met to consider a notice of objection to a temporary event notice (TEN) for Ground Floor, 274 Portobello Road during Notting Hill Carnival. The licensing authority received objections from the Metropolitan Police and the Noise and Nuisance Team. The sub-committee was to decide whether to issue a counter notice, take no action, or impose conditions.

Temporary Event Notice: 274 Portobello Road

The sub-committee was scheduled to consider a report regarding a TEN submitted by Mr Mohammed Zomlot for the premises at Ground Floor, 274 Portobello Road, W10 5TE.

Mr Zomlot submitted the TEN for Sunday 24 and Monday 25 August 2025, to sell alcohol through a window onto Acklam Road during Notting Hill Carnival for consumption on and off the premises. The maximum number of people permitted at any one time was indicated as 35.

The hours of licensable activities were listed as:

• Sunday 24 August 2025 from 12:00 to 19:00
• Monday 25 August 2025 from 12:00 to 19:00

The premises already has a premises licence, which permits the sale of alcohol, and provision of late night refreshments.

PC Tom Stewart, on behalf of the Metropolitan Police, objected to the TEN on the grounds of the prevention of crime and disorder and public safety.

PC Stewart has concerns that the proposed sale of alcohol into Acklam Road is likely to have a negative impact on crowd flow and dynamics.

PC Stewart had visited the premises and suggested selling alcohol from the side terrace into Acklam Road rather than selling on Portobello Road. He was awaiting confirmation of the trading stalls to be set up inside Acklam Road, as this could directly affect the notice.

Mr Philip Richardson, on behalf of the Environmental Health Noise & Nuisance team, objected on the grounds of public safety.

Following discussions with Mr Zomlot, Mr Richardson recommended operating the TEN from the conservatory into Acklam Road, subject to confirmation of the final plans of the street traders in Acklam Road. Mr Richardson raised concerns that the notice would undermine public safety because the location is near street trading stalls on Acklam Road, an area known for heavy congestion. He stated that the notice was likely to worsen congestion by drawing and holding people at the site, which could negatively affect crowd flow.

The sub-committee was reminded that it must consider the licensing objectives¹ when determining the matter.

The sub-committee could take the following steps:

• Issue a counter notice if it considers it necessary for the promotion of any of the licensing objectives to do so.
• Take no action, and allow the notice to have effect.
• If the premises has the benefit of a premises licence impose one or more conditions which are specified on the premises licence which the committee considers are not inconsistent with the carrying out of the licensable activities under the temporary event notice.
