The Licensing Sub-Committee met to discuss an application to vary the premises licence for The Prickly Pear on High Street, Bruton. The sub-committee decided to grant the application with the conditions agreed between the applicant and the police endorsed on the licence.
The Prickly Pear Licensing Application
The Licensing Sub-Committee considered an application by Prickly Pear Productions Ltd to vary the premises licence for The Prickly Pear, 45 High Street, Bruton, BA10 0AW. The application sought to update the premises licence following a full internal and external refurbishment, including reconfiguring the layout, increasing seating capacity, renovating the garden areas, and adding a retractable roof structure to the side garden. The applicant also proposed changes to the timings for licensable activities and the addition of the first floor to the licensed premises1.
The report presented to the sub-committee outlined the details of the application, noting that the licensing authority had received five representations from other persons and one representation in support of the application from Bruton Town Council. Concerns raised in the representations included:
- The extension of the premises into the first floor potentially increasing noise.
- Earlier start times for alcohol and entertainment leading to longer periods of disruption and daytime anti-social behaviour.
- Noise and outdoor activity continuing beyond 22:00.
- Lack of time restrictions on outdoor areas.
- New patio doors worsening sound leakage.
- Parking issues outside the premises.
The applicant, Mr Rupert Toms, a director of Prickly Pear Productions Ltd, responded to these concerns, stating that a noise limiter had been installed and that they wished to work with Environmental Health to set an appropriate level.
Bruton Town Council supported the application, noting that the licence holder intended to operate a different kind of business with extensive dining facilities.
During the consultation period, the applicant agreed to conditions with Avon and Somerset Police, which were then shared with those who had made representations against the variation.
The Licensing Sub-Committee decided to grant the application for a variation of the Premises Licence as applied for, and the conditions agreed by the applicant and the Police were endorsed on the Licence.
