Freeport Progress Report
From: Cabinet - Wednesday, 9th October, 2024 7.00 pm - October 09, 2024
Thames Freeport is forecast to generate 21,000 jobs, £4.6bn of public and private sector investment together with funding to support the delivery of Freeport objectives. The Council has three roles in relation to the Freeport, as Accountable Body, as a partner and as a Billing Authority. As Accountable Body (AB) for Thames Freeport, the Council is accountable to the Ministry of Housing, Communities and Local Government (MHCLG) for the use of public funding and for the good governance of the Freeport including the Thames Freeport Governing Body. As a Billing Authority the Council also has responsibility for the use of retained business rates. This report updates Members on delivery of the Freeport programme with a particular focus on governance arrangements, business rates and the seed capital funding programme. It also seeks to reaffirm delegated decisions to enable the Council to carry out its responsibilities as Accountable Body for the Freeport in an effective and efficient manner.

Change to the contract procedure rule (Chapter 9, Part 2 of the Council’s Constitution)
From: Cabinet - Wednesday, 9th October, 2024 7.00 pm - October 09, 2024
The regulations currently governing the way public procurements are undertaken is the Public Contracts Regulations 2015 (PCR 2015). These rules are set to change in October 2024. The Procurement Bill reforming the current procurement rules received royal assent in October 2023 and was passed into law as the Procurement Act 2023 (referred to as the Act in this document). Once implemented, the Procurement Act 2023 will replace the current Public Contracts Regulations 2015, the Concessions Contracts Regulations 2016 and the Utilities Contracts Regulations 2016 to become the law that regulates public procurement in England, Wales and Northern Ireland. The change in the procurement regulations necessitates amending the council’s contract procedure rule (CPR) to ensure compliance with the Procurement Act 2023 for the procurement of supplies, services and works. This report provides a brief overview of the Procurement Act 2023 and the amendments to the council’s contract procedure rule.
