The minute of the previous meeting was approved, and it was notedthat:

Since the meeting on 28 April 2026, further to consultation with the Chair, and as per notification sent to Committee Members, the Planning Service have made minor amendments to the conditions for Item 4 – APP/2025/1886 – Land at International Golf Course, Balmedie.  The amendments do not alter what was discussed at the Formartine Area Committee or alter the original intention of the conditions, however they are required to ensure that the conditions are accurate and enforceable to ensure that the Planning Service receive the Biodiversity Enhancement Plan and that it is implemented on site.

The first amendment was to remove condition 1 from the decision notice, as the development has commenced. Condition 1 previously read as follows:

  1. In accordance with Section 58 of the Town and Country Planning (Scotland) Act 1997 (as amended) this planning permission will lapse on the expiration of a period of three years from the date of this decision notice, unless the development is begun within that period.

Reason: Pursuant to Section 58 of the Town and Country Planning (Scotland) Act 1997 (as amended).

The second amendment was to alter the wording of condition two, from requiring the developer to submit the Biodiversity Enhancement Plan prior to works commencing to submitting the information within 6 weeks of the decision notice. This is also because the development has commenced on site. This condition now reads:

  1. Within 6 weeks of the date of this decision notice a Biodiversity Enhancement Plan (or similar relevant landscape or ecological enhancement document) shall be submitted to and approved in writing by the Planning Authority. This plan shall include but not be limited to the following measures:

a)    Baseline data collected by ecological surveys;

b)    A detailed scaled site plan showing the location of all habitats to be retained, enhanced and created;

c)    A schedule of planting to comprise species, plant sizes and proposed numbers and density;

d)    A programme for the implementation, completion, management, review and monitoring of the proposed biodiversity enhancement;

The approved Biodiversity Enhancement Plan shall thereafter be implemented in full, including any offsite provision and managed in accordance with the approved details.

Reason: In the interests of protecting the biodiversity of the environment.

There were no other alterations.  Conditions 3 and 4 within the original report remain unaltered.
