In considering the balance of
risk under planning legislation, on the grounds that the proposal
was the safer of the parking options available
to the applicant, and that this
material consideration justified a departure to Policy P1 Layout,
Siting and Design of the Aberdeenshire Local Development Plan
2023, the Committee agreed that authority to grant Full
Planning Permission be delegated to the Head of the Planning and
Environment Service, subject to appropriate condition/s.
