Exemption from publication: There are
confidential appendices to this report, which are exempt by virtue
of paragraph 3 of Schedule 12A of Part 1 of Schedule 12a of the
Local Government Act 1972 because they contain information relating
to the financial or business affairs of any person (including the
authority holding that information).

To renew the lease regarding EE Ltd. (EE), Telecommunications
Installation at NCO, Walton Street, Aylesbury, HP20 1UA.

Reasons for the decision

On the 1st December 2007 the Council granted a
Lease to EE in regards telecommunications equipment installation on
the roof at NCO, Walton Street, Aylesbury, HP20 1UA.

This Lease expired on the 30th November 2017 and EE have been
holding over on existing terms, since then.

EE have recently served Tribunal proceedings on the Council seeking
the renewal of lease.
Heads of Terms (HoTs) have been agreed with EE in regards a lease
renewal. The agreed HoTs are contained within the confidential
appendix.

Alternative options considered

The Council could proceed to Tribunal seeking
better terms. However, considering recent case law, it is unlikely
that improved terms would be achieved, and the Council would incur
high legal/Counsel/surveyor/Tribunal fees.
