It was moved by the
Leader, Seconded by Councillor
Patient,   RESOLVED that:   (a)         all non-executive powers and
functions under the TCPA 1990, the PLBCA 1990 and the HA 1980
required to deliver the Scheme are transferred or delegated to
Kirklees Metropolitan Borough Council;   (b)         delegated authority be given to the
Head of Legal and Democratic Services, in consultation with the
Director of Regeneration and Strategy, to negotiate and agree the
terms of the Agreement with Kirklees Metropolitan Borough Council
to enable the transfer of the non-executive powers and functions
under the TCPA 1990, the PLBCA 1990 and the HA 1980 as set out in
Appendix A required by Kirklees Metropolitan Borough Council to
deliver the Scheme;   (c)          delegated authority be given to the
Head of Legal and Democratic Services to seal and complete the
Agreement and enter into all additional legal documents necessary
to transfer the non-executive powers and functions under the TCPA
1990, the PLBCA 1990 and the HA 1980 as set out in Appendix A
required by Kirklees Metropolitan Borough Council to deliver the
Scheme;   (d)         delegated authority be given to the
Head of Legal and Democratic Services, in consultation with the
Director of Regeneration and Strategy, to agree to transfer or
delegate any specific additional non-executive powers or functions
not listed at Appendix A should such powers or functions become
necessary as the Scheme is progressed to enable Kirklees
Metropolitan Borough Council to deliver the Scheme and to enter
into any supplemental or additional legal documents necessary to
transfer or delegate those specific additional non-executive powers
or functions required by Kirklees Metropolitan Borough Council to
deliver the Scheme; and   (e)         delegated authority be given to the
Head of Legal and Democratic Services, to seal and complete any
supplemental or additional legal documents necessary to transfer or
delegate the specific additional non-executive powers or functions
required by Kirklees Metropolitan Borough Council to deliver the
Scheme.
