Full council record

Purpose

To inform the Cabinet Member of the need to update the Derbyshire and Derby Joint Minerals and Waste Local Plans Development Scheme.

Decision

That the Cabinet Member:

a)    Notes the need to update the Derbyshire and Derby Joint Minerals and Waste Local Plans Development Scheme.

b)    Approves the Derbyshire and Derby Joint Minerals and Waste Local Plans Development Scheme for:

•      submission to the Inspectors for the Derbyshire and Derby Minerals Local Plan Examination; and

•      submission to the Secretary of State for Housing, Communities and Local Government.

Reasons for the decision

To meet the requirements of the Inspectors for the Derbyshire and Derby Minerals Local Plan Examination in Public; and the County Council’s responsibilities under the Planning and Compulsory Purchase Act 2004.

Alternative options considered

Not to submit the MWDS to the Planning Inspectors for the MLP Examination in Public or to Secretary of State for Housing, Communities and Local Government. However, it should be noted that failure to submit the MWDS to the Planning Inspectors could result in suspension of, or delay to, progressing the MLP to adoption. Failure to submit the MWDS to the Secretary of State would mean that the County Council was failing in its legal statutory obligations under the Planning and Compulsory Purchase Act 2004..
