Decision
To approve an easement to Vistry Homes Limited
Vistry Homes Limited have approached the Council to acquire a permanent underground drainage easement from their adjacent residential development site across an area of council owned land adjacent to Pine Grove, Conisbrough to discharge into a manhole on Pine Grove.
Terms have been exchanged and a premium of xxxxxx has been provisionally agreed plus reasonable surveyor and legal costs
A plan showing the location and route of the easement is shown in Box 2 of the ODR
Alternative options considered
The Council have looked at alternative options but have no grounds to object to the easement or its route. It is the most direct route across the council’s site, the sewer will be adopted and ultimately the developer can requisition Yorkshire Water to invoke their statutory rights to install the drain and the Council would lose any degree of flexibility. The consideration will also generate income for the Council
