Decision

1/ To include provisions within the advertised lease for the Contract, that will transfer responsibility to the successful contractor to maintain the tipping hall roof, solar panels and associated Mansafe system.

2/ To agree to provide the necessary additional funding for Waste and Recycling / Public Building Maintenance (PBM) / Sustainability Team to pay for the remedial works described in Box 3 xxxxxxxxxxx in 2026/27

3/ To agree to provide the necessary additional funding for Waste and Recycling / Public Building Maintenance (PBM) to arrange for ongoing maintenance arrangements through to March 2028, to ensure safe operation of the solar panels and associated Mansafe system to facilitate the award of the Contract (and subsequently entering into a new lease) – xxxxxxxx in 2027/28.

4/ For the Council to retain the feed-in tariff for the solar panels irrespective of the transfer of maintenance obligations for the Solar Panels and associated equipment under the new Contract/lease.

Alternative options considered

The above works were/are deemed necessary to confirm the retained infrastructure is in satisfactory condition, prior to the subsequent award of the Contract – there is no suitable alternative given the health and safety considerations and current contractual obligations.

Incorporating provisions within the advertised lease (forming part of the Contract for 2028 -2036) for the successful contractor to maintain the tipping hall roof, solar panels and Mansafe systemis considered the most effective way of minimising the Council’s liabilities moving forward, whilst ensuring health and safety obligations are met and adequate insurance cover can be provided.
