Full council record

Purpose

There is S106 money left which has to be specifically used in Adwick Park.
A section of the footpath has been identified as requiring resurfacing due to its deterioration. An
estimate has been obtained from the Council’s Highways team of The use of S106
money will mean that this project is not included in the capital bid submitted for repairs of other parks footpaths.
The revenue budget for parks and open spaces is constantly under pressure from the number and cost of ongoing repairs required in all parks and open spaces around the borough. The budget is often overspent through having to carry out repairs which are a health and safety issue. The use of the S106 will mean that the revenue budget is not used for this repair.
The remaining amount of S106 money would be put toward the cost of the recent repair
of the main gate into the park. This was damaged through vandalism in September 2025, the
cost of replacement gates was Most of the cost was covered through an existing capital
budget (Parks Fencing Q3920) however there is a small shortfall of money in that budget
. The remaining S106 money would balance the overspend.

Decision

To use the remaining S106 money from 14/02995/FULM for footpath repair work and
towards the cost of repairing the main entrance gate in Adwick Park.

Alternative options considered

Use revenue budget to finance the repairs/shortfall
The revenue budget (EV047) is identified as a budget pressure year upon year, (budget 2026/27
. The money is used to pay for essential health & safety repairs across all Street Scene managed parks and open spaces. This S106 money is specific to Adwick Park and would mean that the revenue budget does not have to be used for the footpath repair.
The shortfall in the existing capital budget, used for the gate repair, will need addressing from existing revenue streams unless the remaining S106 money can be used to offset the amount.
Using revenue money either to pay for the repair or address the shortfall would result in fewer health and safety repairs being carried out in other parks and open spaces this year.
Include the work in a capital bid
A capital bid has been submitted for essential repairs to parks infrastructure, including various footpath repairs. As part of the capital bid process existing S106 monies should be examined to see if they can be used instead of capital money. To use S106 money for this project would mean that the work does not need to be included within the capital bid.
Do nothing
The footpath repair work if not carried out could leave the Council open to claims from people sustaining injuries through trips/falls. The path will deteriorate more over time increasing the risk of injuries or claims, and the cost to repair will increase the longer it is left untreated.
To not address the shortall in the capital money for Parks Fencing is not an option and needs
addressing to balance the budget.
