The business operator appealed the rating and associated
licence awarded to the business following an inspection under the Animal
Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018.

 

Whilst the appeal was partially upheld, this did not
materially effect the inspecting officer’s decision. The rating and associated
licence remained as awarded.

Reasons for the decision

Requirements contained within the regulations together with
statutory guidance were considered resulting in the decision. In reaching the
decision, advice was taken from the relevant service officers, Legal Services
and external Counsel who has experience in licensing matters.

Alternative options considered

I considered departure from the statutory guidance. However,
in this case I determined this was not appropriate given the need to properly
consider the welfare of the animals in the cattery at any time.
