The Application to Modify S106 Obligations, relevant to
the S106 Agreement dated 22nd December 2020 for land south of Leigh Road,
Wimborne Dorset.
The application seeks to modify Schedule 1, Part
1, Clauses 2.3.2-2.3.6 and 2.3.8-2.3.9 which outline the provision deadlines
for various elements of the Community Sports Facilities (CSF) area in relation
to residential dwelling occupation numbers.

Reasons for the decision
It is
understood that negotiations with the Rugby Club in respect of the detailed
design for the Clubhouse and associated infrastructure are
ongoing, resulting in a request from the applicants
to amend the delivery triggers for the various elements of the
CSF.
The rugby
Club and Dorset Council Leisure Services raise no objection, and I note
that Colehill Parish and WimborneTown Council raise no objection

From the
information available, I am satisfied that the revised timescales do not
constitute a material reduction of benefit to the
community under paragraph 151 (d) of the Constitution (Additional
delegations to the Executive Director for Place Services) requiring referral to
Planning Committee. The application can therefore be delegated.

Note:
It is
important to ensure that Temporary security hoarding remains in
position throughout construction in the interest of public safety and to avoid
damage to the approved fencing. This will then need to be
replaced at the same time as completion of the Clubhouse
with the permanent, approved fencing - and these
requirements should be reflected in the legal agreement.
