Resolved that
 
(a)      
the results of the consultation on proposals to introduce Public
Spaces Protection Orders (PSPO), be noted;
 
(b)      
having been satisfied on reasonable grounds that the statutory
conditions for making such Orders were met, the Elmbridge Borough
Council (Naked Flames and Fishing) Public Spaces Protection Order
2023 be agreed, in the form and covering the locations shown in
Appendices G and H of the report, all in accordance with Section
59, 64 and 72 of the Anti-Social Behaviour Crime and Policing Act
2014;
 
(c)        officers be
authorised to carry out all necessary steps to further consult on
and publicise the said Order for the maximum period of 3 years up
to July 2026;
 
(d)      
the feedback received relating to the proposed PSPO for
unauthorised mooring be noted and a second phase of consultation on
this aspect be undertaken;
 
(e)      
the interim Environmental Enforcement Policy (July 2023), be
agreed;
 
(f)        the
benchmarking of Fixed Penalty Notice (FPN) charges be noted and the
increase of the FPN for Fly tipping to £400 as a fixed amount
and the retention of the Littering FPN of £100, reduced to
£75 if paid within 14 days, be agreed; and
 
(g)      
authority be delegated to the Strategic Director, in consultation
with the Portfolio Holder for Environmental Services, to increase
the levels of Fixed Penalty Notices, as required.
